EB-1A extraordinary ability

Extraordinary ability is the legal name. Einstein visa is the nickname. The test is still 8 C.F.R. 204.5(h): three of ten criteria or a true one-time major award, then final merits.

What the regulation means

USCIS is looking for a small group at the top of the field, not a strong resume at a well-known employer. A degree, a job title, and years of experience are background. They are not the showing.

The five statutory fields are sciences, arts, education, business, and athletics. There is no official list of jobs. Software engineers, physicians, and founders all use the same ten boxes.

How this site uses the phrase

The free check maps your file to those ten boxes and a final-merits read. It does not certify extraordinary ability. Only USCIS decides a petition.

This is not a law firm and does not file petitions. USCIS decides each case on its own record.
