O-1 to EB-1A

O-1 and EB-1A both talk about extraordinary ability. They are different benefits. An O-1 approval does not decide an I-140.

Overlap is not identity

Press, awards, judging, a critical role, and high pay show up in both conversations. The forms, the duration, and the final-merits read are not the same. Reusing an O-1 exhibit list without looking at which EB-1A box each document actually supports is how files get thin.

Founders

O-1 usually needs a petitioner: an employer or an agent. EB-1A can be filed by you. That convenience is real. It does not lower the ten-criteria test. A founder without awards still needs other boxes: a critical role, original contributions others adopted, press about you, or judging. “I started a company” is not one of the ten.

This is not a law firm and does not file petitions. USCIS decides each case on its own record.
