Common questions

Planning scores, not a USCIS decision. More on how we score, EB-1A requirements, and the refund policy.

Is this an EB-1A eligibility calculator?+
Yes, in the planning sense. The free check scores claim versus proof on the ten criteria. It is not a USCIS calculator and it does not approve a case.
Is EB-1A the Einstein visa?+
Einstein visa is a nickname for EB-1A, not a separate form. Same 10 criteria, same self-petition rules. Read the Einstein visa note, then run the free eligibility check.
How long does EB-1A take?+
USCIS processing of the I-140 can take months. After approval, some countries still wait on the visa bulletin. This tool scores evidence. It does not predict wait times.
What is EB-1A?+
EB-1A is the U.S. employment-based first-preference category for people of extraordinary ability in the sciences, arts, education, business, or athletics. Those are the five fields in the regulation. There is no official list of jobs. People often search it as EB1A or EB-1A. You can self-petition. There is no job-offer or labor-certification requirement. You still have to show you will keep working in that field, and that your coming to the United States would substantially benefit the country.
How do I know if EB-1A is even a path?+
USCIS looks at a two-step test. Step 1: at least three of the ten criteria (or one true major award). Step 2: whether the whole record shows sustained acclaim at the top of the field. You also have to intend to keep working in that area, and that your entry would substantially benefit the United States. Our free evaluation maps your resume to those ten criteria so you can see yes / not yet / too early before you pay a lawyer. It is a planning score, not a USCIS decision.
Should I look at NIW or O-1 instead of EB-1A?+
Sometimes. EB-1A is for extraordinary ability and a green card. NIW is also a green card but argues national interest, not “top of the field.” O-1 is a temporary work visa, usually filed by an employer or agent. This site only scores EB-1A. Read the EB-1A vs NIW vs O-1 page, then take a thin EB-1A result to a lawyer before you buy a long plan here.
What are the 10 EB-1A criteria?+
Lesser nationally or internationally recognized awards; membership in associations that require outstanding achievement; published material about you; judging the work of others; original contributions of major significance; scholarly articles; artistic exhibitions; leading or critical role; high salary; and commercial success in the performing arts. Comparable evidence is allowed when a criterion does not fit the field.
Can I apply for EB-1A from another country?+
Yes. Nationality is not a bar. You can live outside the United States and still put a file together. Wait times after approval depend on the visa bulletin, which this tool does not score.
Is this useful if I am self-petitioning?+
Yes. EB-1A lets you file without an employer sponsor, which also means you gather the exhibits. This tool is built for that. It saves time by mapping claim versus proof on the ten boxes, so you collect what is missing instead of guessing. It does not file the petition. How we score.
Does this follow the Kazarian two-step?+
Yes. Step 1 asks whether at least three of the ten criteria (or a major award) are supported. Step 2 looks at the whole record: sustained acclaim, and whether you sit among a small group at the top of the field. Meeting three boxes is not the same as a grant.
Can I upload evidence?+
Yes. Paste a resume or drop in PDFs and letters. We read the text, match it to the ten criteria, and flag patterns officers often reject, such as internal awards or letters with no backup.
Will this write my petition story?+
It drafts a framing outline from the strongest parts of your file. Treat it as a starting note for you and counsel, not a letter you file.
Can I file what it produces?+
No. The report and draft are labeled as drafts. A licensed immigration attorney should review anything before it goes to USCIS.
Is this legal advice?+
No. This is a study and planning tool. USCIS decides each case on its own record. Talk to a qualified immigration lawyer about yours.
Does a company award count as a major award?+
No. USCIS examples of a one-time achievement are Pulitzer, Oscar, and Olympic medal. Nobel-class prizes are treated the same way. Employee-of-the-year, internal, and most field prizes are “lesser” awards and still need 3 of the 10 criteria. Fields, Turing, Emmy, and similar famous prizes are not automatically that tiny set.
What if a criterion does not apply to my field?+
USCIS allows comparable evidence when a criterion does not readily apply, for example, artistic exhibitions or performing-arts commercial success for a software engineer. Comparable proof has to equal the same kind of showing, not a weaker stand-in. We mark those boxes N/A and point you to the criteria that do apply.
What does the free evaluation include?+
Upload or paste a resume. That is enough. You can add up to five extra files if you have them. The free evaluation tells you whether this looks like an EB-1A path: how many criteria are claimed vs exhibit-backed, and a plain-English worth building / not yet / wrong category. Claim score is the resume story. Proof score is the exhibits. On this site, only proof of 70 or above is treated as met for planning, and only with a primary exhibit for that box. A short file list rarely gets you three. USCIS does not use a 70-point grade. You still need 3 met criteria, or one true major award. Full write-up, PDF, and draft stay on paid plans.
Does a 70 mean USCIS will agree the criterion is met?+
No. 70 is our planning cutoff so the report can say met / building / too thin. USCIS officers do not grade 0 to 100. They decide each criterion on the papers in the file, then look at the whole record. A 70 here is not a USCIS finding.
How is the overall score built?+
It is the whole file, not the average of the bars. Each criterion gets a claim score (the resume) and a proof score (the exhibits). Only proof of 70 or above, with a primary exhibit, counts as met. Step 1 still needs three of those, or one true major award. Until then the overall stays in the building range even if one bar is high. How we score.
How is this different from EB-2 NIW?+
EB-1A asks whether you sit at the top of your field with sustained acclaim. NIW asks whether your work is in the national interest. They are different tests. A strong NIW file is not automatically an EB-1A file.
Can a software engineer get EB-1A?+
Yes, if the file shows extraordinary ability, not only a senior job title. Patents with independent use, widely adopted work, selective judging, and pay at the top of the specialty help. Brand-name employers and internal awards usually do not carry Step 1 by themselves.
Is EB-1A the same as an H-1B?+
No. H-1B is a temporary work visa tied to an employer. EB-1A is a green-card category. You can self-petition. Approval of one does not decide the other.
What is an EB-1A petition?+
Form I-140 in the extraordinary-ability classification. You can file it for yourself. This site scores the evidence. It does not file the petition or grant approval. Read the EB-1A petition note, then run the free check.
Do you offer EB-1A premium processing?+
No. Premium processing is a USCIS service on the I-140, paid to USCIS. It can speed a decision. It does not make a thin file strong. We do not sell it.
Are you EB-1A lawyers or attorneys?+
No. EB1AGenius is not a law firm. We score the file so you can see the gaps before you hire an EB-1A lawyer. Counsel files. We do not.
Do you score EB-1B outstanding researcher or professor?+
No. EB-1B needs a qualifying employer and a different test. We only score EB-1A. Read EB-1A vs EB-1B if that is the question.
Can I get a refund?+
Yes, in three cases: Stripe charged you and the full paid report never appeared after you finished evaluation; you were charged twice for the same plan; or you bought Sprint, Pro, or Extended, you have not generated a full paid report, and you ask within 7 days. We do not refund if the report, PDF, or Word file was delivered, including if you disagree with the scores. We do not refund because USCIS later issues an RFE or denial, or because you wanted a lawyer, a filing, or a guarantee. The free evaluation has no charge. Unused days after you have used a full report are not refunded. Refund Policy.
How do I get the money back if I am due a refund?+
Email support@eb1agenius.com from the address on the Stripe receipt. Include the date, amount, plan name, and what went wrong. We aim to reply in 2 business days (U.S. Central). If we refund, Stripe sends the same USD amount back to the card or wallet you paid with, not a different card, cash, or check. It can take 5 to 10 business days to show on your statement. Please write us before you open a bank dispute. Refund Policy.
