EB-1A RFE examples

We do not publish a ranked chart of “most common” RFEs. USCIS does not give us that count. These are the requests that match the criteria officers already find thin.

Original contribution

The officer asks what changed in the field because of you, and who used it without being paid by your employer. A patent number, a talk, or a letter that says “novel” does not answer that. Adoption, citation that actually uses the method, or a standard that names the work is the kind of exhibit the question is pointing at.

Critical role, judging, and pay

Critical role: prove the organization is distinguished and that you were leading or critical, not merely employed. Judging: prove you were invited as an expert and that you completed it. High salary: prove the comparison group, not only the compensation number.

Final merits is often the last section even when three boxes were accepted. It asks whether the whole file shows sustained acclaim. Meeting three criteria on paper and losing final merits is a known outcome, not a contradiction.

This is not a law firm and does not file petitions. USCIS decides each case on its own record.
