EB-1A vs EB-2 NIW vs O-1A

These are three different filings, not three names for the same path. EB-1A and NIW can lead to a green card. O-1 is a temporary visa. This page is a map so you know which conversation to have first. It is not a recommendation and it is not legal advice.

EB-1A vs EB-2 NIW

EB-1A is extraordinary ability. NIW is national interest. Both can lead to a green card. A thin EB-1A file is not automatically a strong NIW file. We only score EB-1A. Longer note on EB-1A vs NIW.

EB-1A vs O-1A

O-1A is a temporary work visa. EB-1A is a green card category. Overlapping evidence, different outcome. Longer note on EB-1A vs O-1A.

EB-1A vs EB-1B outstanding researcher

EB-1B is outstanding professor or researcher. A qualifying employer files. You generally cannot self-petition. We do not score EB-1B. Longer note on EB-1A vs EB-1B.

What you get

EB-1A

A green card (permanent residence), if approved.

EB-2 NIW

A green card (permanent residence), if approved.

O-1A

A temporary work visa. It is not a green card.

Who files

EB-1A

You can file for yourself. No employer sponsor and no labor certification. You must still intend to keep working in the field, and that coming to the United States would substantially benefit the country.

EB-2 NIW

You can file for yourself. The job-offer and labor-certification requirements are waived if the national-interest test is met.

O-1A

Usually an employer or agent files. You generally cannot self-petition.

The legal test, in short

EB-1A

Extraordinary ability. Either a one-time major award or at least three of ten criteria, then a separate look at the whole record (final merits).

EB-2 NIW

EB-2 (advanced degree or exceptional ability) plus Matter of Dhanasar: the work has substantial merit and national importance, you are well positioned to advance it, and on balance the United States benefits from waiving the job offer.

O-1A

Extraordinary ability for a specific position or event. O-1A (sciences, education, business, athletics) uses criteria that look similar to EB-1A but serve a different visa.

Typical evidence

EB-1A

Independent proof you sit in a small group at the top of the field: original work others use, judging, press about you, selective membership, high pay, a critical role at a distinguished organization.

EB-2 NIW

A clear project or body of work that matters to the United States, plus proof you can actually carry it out. Letters from independent experts help. You do not have to prove “top of the field” the way EB-1A does.

O-1A

A petition tied to upcoming work in the United States, plus extraordinary-ability evidence and an advisory opinion from a peer group or union where required.

Timing, roughly

EB-1A

EB-1 dates are often current, so the wait is mostly USCIS processing. That can still take months.

EB-2 NIW

EB-2 dates can be current or badly backlogged, especially for people born in India or China. Ask a lawyer to read the current Visa Bulletin for your country.

O-1A

Often the nearer option if you need to start work in the United States on a known date. Premium processing is commonly used.

What this site scores

EB-1A

Yes. The free evaluation and paid reports map your file to the ten EB-1A criteria and final merits.

EB-2 NIW

No. We do not score Dhanasar prongs. If EB-1A proof looks thin, NIW is the conversation to have with counsel.

O-1A

No. An O-1 petition is a different filing. Strong EB-1A evidence often helps an O-1 discussion, but this tool does not produce an O-1 packet.

Rules: 8 C.F.R. § 204.5(h) (EB-1A); 8 C.F.R. § 204.5(k) and Matter of Dhanasar (NIW); 8 C.F.R. § 214.2(o) (O-1).

When EB-1A is usually the first talk

  • You already have independent exhibits, not only a strong resume, for at least three of the ten criteria, or you have a true one-time major award (Pulitzer, Oscar, Olympic medal, and the like).
  • The record shows other people using or recognizing the work, not only your employer praising you.
  • You want a green card and can live with USCIS taking a close look at “top of the field.”

When NIW often comes first

  • The work is important to the United States (public health, critical technology, a field the government actually cares about), but you cannot yet show sustained national or international acclaim.
  • Fewer than three EB-1A criteria have real proof. Job title, a master’s degree, and internal awards are not a substitute.
  • You would rather argue national interest than “small percentage at the top of the field.” For some countries the EB-2 wait is long. That is a lawyer question, not a website score.

When O-1 is often the nearer step

  • You need to work in the United States on a known timeline and a green card will not be current or ready in time.
  • An employer or agent is willing to petition, and you can document extraordinary ability for that role.
  • O-1 is not a lesser EB-1A. It is a different visa. Some people later file EB-1A or NIW from O-1 status. That sequence belongs with counsel.

What to do on this site

Run the free EB-1A evaluation. If three or more criteria have real proof, exhibits, not only resume lines, the $49.99 report is the next useful step before you sit with a lawyer. If the free check shows the file is still thin, do not buy a three-month plan hoping the score will invent evidence. Take that result to counsel and ask about NIW or O-1.

We do not file petitions. We do not predict USCIS decisions. Priority dates, premium processing, and whether you can hold status while a case is pending are lawyer questions.
