EB-1A for AI engineers

Also searched as EB1A for AI engineers.

Can AI engineers get EB-1A? Same 10 criteria. Papers, adopted models, judging, and a critical role can matter. No PhD required. Free check. Not a USCIS decision.

Who this is for

Machine-learning and AI engineers who can point to work other people used, not only a model that shipped inside one company.

Evidence that usually matters

What often does not hold up

There is no AI-engineer visa

USCIS does not have a separate EB-1A for AI. The regulation is the same ten criteria used for sciences, arts, education, business, and athletics. An AI engineer usually sits in sciences. You still need three of ten, or one true one-time major award, and then final merits.

A Staff or research title at a well-known lab is context. It is not extraordinary ability by itself.

What usually carries an AI file

Officers look for work that moved the field, not a private leaderboard inside one company. A paper helps when the venue is real and someone independent used the result. A model that other companies or papers depend on can be an original contribution even when the citation count is modest. Judging has to be finished expert review, not a talk you gave.

  • Paper plus independent citations or adoption, not a count alone
  • Open model, library, or benchmark that people outside your employer use
  • Program-committee or peer-review invitations and proof you completed them
  • Press about you or the contribution, not only the company’s launch post

No papers is not an automatic no

Many AI engineers have no scholarly articles. Authorship is then not your box. Patents with use, a critical role, judging, high salary with a real survey, or independent press have to be the file instead. Compare that with EB-1A vs NIW if the acclaim record is still thin. A PhD does not fill a missing box.

EB-1A is a self-petition. You can be in any country. The statute names five fields (sciences, arts, education, business, athletics). Meeting three criteria is only Step 1. Final merits still has to show sustained acclaim.

This is not a law firm and does not file petitions. USCIS decides each case on its own record.
